Indemnification

General Provisions
Any provision of this User Agreement that is prohibited by law, or is unlawful or unenforceable under applicable law, shall be ineffective only to the extent of such prohibition, without invalidating the remaining provisions of this User Agreement. This User Agreement and all matters relating to the use of and access to this site shall be governed in all respects by the laws of Mexico. Any claim arising out of this User Agreement or use of and access to this site shall be subject to the exclusive jurisdiction and venue of the courts of Mexico D.F. (Mexico City), United Mexican States. You irrevocably consent to the personal and exclusive jurisdiction of these aforementioned courts. No failure of Stewart Title Guaranty de Mexico to insist upon strict performance of the terms or conditions of this User Agreement or as otherwise set forth in stewart.com or as required by Stewart Title Guaranty de Mexico ("terms and conditions") and no failure of Stewart Title Guaranty de Mexico to exercise any right or remedy available upon any breach of said terms or conditions shall constitute a waiver of any such breach or of any of such terms or conditions.

Stewart title guaranty de México no se hace responsable por la indisponibilidad del sitio, ya sea por falla de la energía eléctrica, mantenimiento o mal funcionamiento del equipo de cómputo, o por cualquier otra causa de fuerza mayor o caso fortuito.
Stewart title guaranty de México no se hace responsable, ya sea por contrato, delito civil o algun otro hecho, de cualquier daño o perjuicio directo o indirecto sufrido por sus usuarios, ni por la interrumpcion o perdida de negocio, informacion o del proceso productivo de éstos, ni por el uso realizado por terceros. Dicho deslinde de responsabilidad es valido aun cuando Stewart Title Guaranty de México haya sido notificado de la posibilidad de dichos daños.
Stewart title guaranty de México no se hace responsable por el mal uso de la información publicada en el sitio, ni por el mal uso o indebida apropiacion de los passwords designados o por la posibilidad del acceso ilegal al sitio o a los reportes generados en consecuencia.
Indemnización.
Usted, el usuario, se obliga a defender, indemnizar y sacar en paz y a salvo a Stewart
Title Guaranty de México de y contra cualquier demanda, pleito
o litigio, sea directo, indirecto por cualquier daño o perjuicio directo o indirecto, incluyendo, sin limitación, los gastos y costas del juicio y los honorarios profesionales devengados, que sean generados directa o indirectamente de una violación por su parte del presente contrato o de los derechos de terceros, incluyendo, sin limitación, la infracción
de derechos de propiedad intelectual, derechos de propiedad o derechos a
la privacidad.
Condiciones generales.
La declaracion de nulidad de cualquier
cláusula o disposición del presente contrato, no supone la nulidad
de la totalidad del mismo, por ende el mismo seguirá siendo válido.
La intepretación del presente contrato se sujetará a las leyes de los estados unidos mexicanos. Cualquier litigio que surja del presente contrato y del uso y acceso al sitio se somete a los tribunales federales con sede en el distrito federal. Usted renuncia a cualquier otra jurisdicción que fuere competente con motivo de su domicilio presente o futuro.
Ninguna omisión por parte de Stewart Title Guaranty de México de insistir en el estricto cumplimiento de los términos y condiciones del presente contrato o como esta estipulado en el sitio stewart.com o se requiere por Stewart Title Guaranty de México (“terminos y condiciones”) ni la omisión de perseguier cualquier acción legal por el incumplimiento del mismo, se consideran una renuncia a tales derechos.
